## What to know before you hire a trademark attorney.

Plain answers to the questions brand owners ask most, from what a trademark attorney does to how long a registration lasts. General information, not advice on your mark.

### What does a trademark attorney do?

A trademark attorney protects the names, logos and slogans that identify your business. The work runs from before you file until long after the registration issues.

- **Clearance.** Searches the federal register and the marketplace for conflicting marks before you invest in a name.
- **Filing.** Picks the right classes, writes the description of goods and services, and files the application.
- **Prosecution.** Answers USPTO office actions, from likelihood of confusion refusals to specimen problems.
- **Maintenance.** Tracks the declarations and renewals that keep a registration alive.
- **Enforcement.** Sends cease and desist letters, opposes conflicting applications and handles infringement disputes.

Federal registration runs through one national office, the USPTO, so a US trademark attorney can file and prosecute your application wherever your business is based.

### Trademark attorney, online filing service or do it yourself?

All three can get an application on file. The difference shows up after filing. In the USPTO's fiscal 2026 data, only about 36 percent of base applications were approved on the first review. Most applicants receive at least one office action, and that is where an online form stops helping.

*Ways to file a US trademark compared*

| | Do it yourself | Online filing service | Rapacke Law Group |
| --- | --- | --- | --- |
| **Conflict search** | Your own search of the register | Varies, often automated or an add-on | An attorney searches and analyses every relevant result |
| **Who prepares it** | You | You, through a form | A US trademark attorney |
| **Goods and services** | Your wording, with surcharges for free-form text | Template wording | Written around what you sell, in USPTO-accepted wording |
| **Office actions** | You answer them | Often extra, or not offered | Every response included |
| **Fee** | USPTO fees only | Service fee plus USPTO fees, plus extras | $2,000 flat, USPTO fee for one class included |
| **If the USPTO denies it** | USPTO fees are not refunded | Depends on the service | Approved, or your money back\* |

### How does trademark registration work?

Registration usually takes most of a year, longer for marks not yet in use. In the USPTO's fiscal 2026 figures, applications waited about 4 months for a first review and about 9.5 months on average to a final decision.

1. **Clearance search.** Before you file, so you do not build a brand on a name you cannot keep.
2. **Application.** Filed on use in commerce or on an intent to use the mark. We file most applications within about five business days.
3. **Examination.** A USPTO examining attorney reviews the application and either approves it or issues an office action.
4. **Office actions.** Each one has a 3-month deadline, extendable once by 3 months.
5. **Publication.** The mark is published in the Official Gazette, and anyone who believes they would be harmed has 30 days to oppose or ask for more time.
6. **Registration or notice of allowance.** A mark already in use registers. A mark filed on intent to use receives a notice of allowance, and you have 6 months to file a statement of use, extendable in 6-month steps up to 36 months.

### How much does it cost to trademark a name?

With us, $2,000 flat for one mark in one class. That covers the conflict search, the application, every office action response and the USPTO filing fee for one class. The USPTO's own fees are set by regulation.

*USPTO trademark fees, schedule effective January 18, 2025*

| USPTO fee | Amount | When |
| --- | --- | --- |
| **Base application** | $350 per class | At filing |
| **Insufficient information surcharge** | $100 per class | If required details are missing at filing |
| **Free-form goods and services** | $200 per class, plus $200 for each extra 1,000 characters | If you don't use the USPTO's ID Manual wording |
| **Statement of use** | $150 per class | Intent-to-use marks, once in use |
| **Extension to show use** | $125 per class | Each 6-month extension |
| **Section 8 declaration** | $325 per class | Between years 5 and 6, then with each renewal |
| **Section 9 renewal** | $325 per class | Every 10 years |

### What can be trademarked?

Anything that tells buyers who a product or service comes from. Most often a business or product name, a logo or a slogan, and sometimes a sound, a color or the look of packaging. Strength depends on how the mark relates to what you sell.

*The spectrum of trademark strength*

| Type of mark | Example | Strength |
| --- | --- | --- |
| **Fanciful** | An invented word, like KODAK | Strongest |
| **Arbitrary** | A real word with no link to the product, like APPLE for computers | Strong |
| **Suggestive** | Hints at a quality and takes imagination, like COPPERTONE for sunscreen | Registrable on its own |
| **Descriptive** | Describes the product, like CREAMY for yogurt | Weak. Principal Register only after it acquires distinctiveness |
| **Generic** | The common name of the product | Never registrable |

See [real examples of descriptive trademarks that succeeded](https://arapackelaw.com/trademarks/examples-of-descriptive-trademarks/) and [how trademark classes work](https://arapackelaw.com/trademarks/trademark-service-classes/).

### TM or ®, and do you need to register at all?

You can use TM with a name or logo at any time, registered or not. The ® symbol is only for a federally registered mark, and only for the goods and services in the registration.

Using a mark gives you common-law rights, but only where you actually trade. A federal registration gives nationwide notice of your claim, the presumption that you own the mark, and the right to sue in federal court and record the mark with US Customs.

More in [TM vs ® trademark symbols](https://arapackelaw.com/trademarks/tm-vs-r-trademark/) and [state vs federal trademarks](https://arapackelaw.com/trademarks/state-vs-federal-trademarks/).

### How long does a trademark last?

A registration can last indefinitely, as long as the mark stays in use and the filings are made on time. Miss them and the registration is cancelled.

- **Between years 5 and 6.** File a Section 8 declaration that the mark is still in use.
- **Between years 9 and 10, and every 10 years after.** File the Section 8 declaration with a Section 9 renewal.
- **Grace period.** Each deadline has a 6-month grace period, for an extra fee.

### Applying from outside the US?

Applicants and registrants whose business is based outside the United States must be represented before the USPTO by an attorney licensed in the US. We file for founders and companies abroad, and can extend a US filing to other countries through the Madrid Protocol.

## From first call to a registered trademark.

What happens at each step and who does the work. Timing shown is typical, never a promised date.

1. **Strategy call** (Day one). Free. Talk through the name, the logo and where you sell.
2. **Conflict search** (Our team). An attorney searches the register and analyses every relevant result.
3. **Application drafted** ($2,000). Built around your goods and services, approved by you.
4. **Filed with the USPTO** (~5 business days). Most applications are filed within five business days.
5. **Examination** (About 4 months). We answer every office action, included in the fee.
6. **Published for opposition** (30 days). A 30-day window for anyone to oppose.
7. **Registered**. Your mark is on the federal register and you can use the ®.

## Questions about our trademark attorney services.

### How much does a trademark attorney cost?

With us, $2,000 flat for one mark in one class, with the conflict search, every office action response and the USPTO filing fee for that class included. You know the fee before any work begins, and it does not grow when the USPTO writes back.

### If there is an existing trademark similar to mine, can I still register it?

It depends. If the other mark is used for unrelated goods or services, you may still be able to register and use yours, like DOVE for soap and DOVE for chocolate. If the goods are related and the marks look, sound or mean the same, the USPTO is likely to refuse it. The conflict search answers this before you file.

### Do my brand name and logo need to be registered separately?

Usually, yes. Each application covers one mark. A name filed in standard characters protects the words in any style, which is usually the place to start. A logo filed as a design mark protects that look, and a logo that combines words and a design is treated as one mark with a narrower scope.

### How long does it take to register a trademark?

We file most applications within about five business days. In the USPTO's fiscal 2026 figures, the first review came about 4 months after filing and a final decision about 9.5 months after filing on average. Marks filed on an intent to use take longer, because they register only after you show use.

### Could my trademark application get rejected by the USPTO?

Yes, it is always possible, most often for likelihood of confusion with another mark or because the mark describes the product. With us, you are covered by The RLG Guarantee. If the USPTO denies your trademark, a full refund. Registrability issues, a refund or more searches. Refunds are subject to the RLG Guarantee Policy in your engagement letter.

### What does The RLG Guarantee cover for trademarks?

Your trademark registration. Get your trademark approved, or get your money back. Office action responses on applications we did not file, oppositions, international filings and litigation are not covered. The guarantee is a refund promise, not a promise of registration.

### Do I need a trademark attorney to file a trademark?

A US-based applicant can file alone. Most applicants receive at least one office action, and a refusal usually turns on legal argument and evidence, which is where an attorney helps most. Applicants based outside the US must be represented by a US-licensed attorney.

### Can I trademark my business name if I already have an LLC?

Forming an LLC registers the name with your state for that entity. It does not give you trademark rights or stop a business in another state from using the name. A federal trademark registration does that, nationwide.

### What is the difference between TM and ®?

TM can be used with any mark you claim, registered or not. The ® can only be used once the USPTO registers the mark, and only for the goods and services listed in the registration.

### Do you work with brands nationwide?

Yes. Trademark registration is federal, so we work with founders and companies in all 50 states, and with applicants abroad who need a US attorney.
